Unable to get Response from DWP/PIP

Unable to get Response from DWP/PIP was created by Maxpower99
I wonder if anyone can point me in the right direction. I deal with my sons PIP as he is not fully capable of doing so. Recently he received a PIP Review letter.He tried to complete it himself but unfortunately he ruined the form
Because it had to be returned by 30/09/21 and little time available, the DWP were written to explaining the issue and requesting a replacement form.
Had no reply at all, so sent a further request. by recorded delivery, explaining that in accordance with the Review Form I was notifying them of the reason why the form had not been returned and a further request for another copy. This was to ensure his benefit would not stop. Never got a response to the letters but received a letter stating that the benefit will stop. Problem is unable to make contact with the DWP, the phones are not answered and there is no other way to make contact with them apart from writing which has been done. Can anyone suggest what approach is now made, cant lodge a complaint as it ha to be by telephone. Completely stumped. Thanks.

Yes tricky one!
I think there are two possible answers.
Are you an Appointee? If so make this clear with either option.
1. How ruined is the form? Is it scribbled on, wrong answers or what? If it is still legible, or you have a previous form with the questions, you could write the answers on a blank page, numbering them accordingly. Explain about the form and enclose it with the other pages. Make sure son's NI Number and name are clearly on each page. Explain that you have been told that son's benefitvwill stop if the form is not returned etc
2. Second possibility. Write to DWP at the usual address, but address this to Complaints. (Yes this can be done!)
Complaints team has lawyers etc that can respond quickly and purposefully!
Head your letter COMPLAINT - MALADMINISTRATION
(PIP Claim Son's name/NINumber)
I wish to complain on behalf of my son, OR as my son's Appointee.
Your complaint is that despite X amount of correspondence DWP have failed to send a replacement form, and as a result of this Maladministration your son's PIP will now be stopped.
Explain as you have above. Set out all the previous correspondence and dates with copies if you have them.
Use bullet points.
Then you can add eg that (as appropriate) that your son is seriously disabled, and relies on benefits. Explain his lack of ability and that's why you act for him, and/or are his appointee.
Under Human Rights Act (ECHR Article 1 of the First Protocol: Protection of property) you have a right to protection of possessions and this includes a right to receive social security benefit.
So write your letter saying you wish to complain and its a breach of ECHR article 1 etc ... as DWP ua Makadministratiin which comprises a failure to deal with correspondence have created an impossible barrier to allow your son to continue to claim PIP, this is also discriminatory under Equality Act 2010,
then make it clear that you will be referring the matter to a lawyer to seek Judicial Review, ( to prevent DWP stopping your son's benefit payments) if there is no response within 14 days of the date of the letter.
It is highly unlikely that you will need to refer to a lawyer but this would be the next step anyway!
Keep copies of everything you send, and again send recorded delivery.
You could always try a double pronged attack. Do both options, but state on the option 2 letter that you have returned the ruined claim form with further information separately.

Hi maxpower99,
Although it is frustrating the DWP will eventually answer the phone. It can sometimes take up to an hour but you will get a reply. I think you really need to do this to explain your situation.
rather than just waiting for an answer I put my phone on loud speaker and just get on with something else until they answer, it makes the time go past quicker

Hi maxpower99, The best time to ring the pip helpline is when they open at 9am. The last couple of times I have rung I have done this and only waited a maximum of 15-20 minutes. I know it isn't always possible to ring at this time but worth a try if you can.

Hi Maxpower99,
I would invove your MP.
I have done this more than once and had satisfactory outcomes each time. All you need to so is type 'contact my MP' into google and then put in your postcode and then you will be taken through to the MP's email
address box in which to type your query.
The beauty of this is; your MP will be in touch with the relevant DWP department, in your case 'complaints' by email making it much quicker and more secure.
Once you have the confidence of your MP they may be able to pass on other documentation relevant to your case for you without you having to worry about it getting there.
This happened on my last review. I sent copies of documents taken with my phone camera and attached them to emails to my MP.
This can't be a promise as I guess all MP's work differently, but up now I have always had positive outcome.
