got PIP decision was created by Hazel
so finally got my decision through today, thought I'd start a new thread as now we are into the rhelms of manditory reconsiderations

I have gotten zero points...

there is total nonsense in the responing, including saying that I scored well in a "mental state exam2 when no such exam was preformed... I think the deicision maker only took the PA4 into account and ignored everything else if I am honest... I also think that both the assessor and decision maker have no idea how hard it is to get mental health treatment without going private - which I cannot do unless I get PIP to pay for it

so ye... zero points... MR journey will start next week

Hi Hazel

Not the news you wanted to hear.

The first thing you need to do if you have already not requested one, is to ask the DWP for a copy of the assessors report (PA4). When you have a copy of the report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will now be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say 'in my opinion' you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said., remember they are just an opinion which is not based on fact.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

I requested the PA4 straight after my assessment so have had it for a few weeks now. I also wri6te a letter to the decision maker after receiving the PA4 explaining which bits I felt didnt reflect the true nature if my difficulties, not 100% sure the decision maker read it though as their reasonings in the decision letter are very similar to what the PA4 said. With the addition of my apparently scoring well on a "mental state exam" which was not mentioned in the PA4 and I'm 90% sure never even happened...

Their main reasons for my being uneligible for points seem to be:

1. That I work 1 day a month delivering leaflets
2. That i did a (predominately online) college class last year for 3 hours a week
3. That my medication are only first line meds
4. That i dont have "significant input from mental health specialists" - in the last year I have been under the care of IAPT, then referred to the early intervention team, then referred to CMHT and now see a care coordinator once a fortnight (over video call) and have been on a waiting list to see a psychiatrist for a med review since march
5. That I went to university (in 2010)
6. That i go to a shop once a week (it conveniently missed the fact that I am accumpanied)
7. That despite being autistic I lack any comorbid interlectural or developmental conditions - I cant remember exact words right now but that's essentially what the decision letter concluded with

So going to start by trying to pick those 7 things apart then go through the descriptors one by one.

Hello Hazel,

I have lost count of the number applications which were initially scored 0 points, and then went on to get the correct award at either MR or Appeal. Please use your frustration to give you energy to fight on!

Hi Hazel,

I'm so sorry to hear that you scored zero points for your assessment. Having said that, I will try to help you fire yourself up for the next stage.

In 2018 I scored zero points and it made me even more determined to prove that I was worthy of the lower daily living and higher mobility component, which I have been in receipt of since 2014.

I fought tooth and nail and eventually had it overturned at the MR stage and my points magically went up to twenty two and my old award was reinstated.

I have always believed that one of the contributing factors was the fact that I had been given zero points which stood out like a sore thumb as it was so wrong. Copy and paste was the weakness in the report and it was obvious it was rushed, too.

It was so full of inaccuracies and, dare I say it, lies that it wasn't really hard to see through it.

I can see from your posts that you are already geared up for it so let the battle commence. Carry on being as bold as you have been in your posts and keep the positivity going and you are already half way there.

I won't advise you how to approach the MR itself by way of words as it looks as though you know exactly what you are doing already.

One last thing, I would definitely write to your MP on the lines of 'in my opinion the decision maker, in all innocence, was misled by the inaccuracy of the assessment report and therefore came to the wrong conclusions'........etc....etc.......

Anyway, the very best of luck and please let us know stage by stage how you are doing.

Kind regards,

Phrank.
