I have been denied 3 times the backdated payment for the Daily Living descriptor of Mixing with others from Jan 2017 to Nov 2020. I asked for MR after DWP wrote to me in March 2021 and was told I come under High Court ruling of MM v DWP but this has yet to be finalised. After consulting B&W I requested that my claim be looked at again. Denied with same decision paragraph....this has yet to be finalised. I applied again in April 2021 citing if I was awarded 4 points for that descriptor at my last assessment Nov 2020 then do I not qualify for the same points from Jan 2017 when I first claimed. Same old claptrap....this decision has yet to be finalised. I applied again in Sept 2021....yup you've guessed it! The decision has yet to be finalised. As we're talking about approx 5K I am more than a little upset. So I phone DWP (82 mins wait in total) was passed between 3 people and asked for explanation about the decision. It was rather vague, a pleasant gentleman wouldn't really commit himself but did say any back payment, if applicable, would only be from July 2019 when judgement was passed. Not according to this site I politely informed him. He suggested I leave it a couple of months then ring and enquire? I believe this treatment to be stalling tactics as nobody has justified or reasonably explained the decision. Now the big question. Do I take it to an appeal.

Sorry bit long winded but I wanted to show DWP behaviour.

I would advise you to seek help from your Welfare Rights Organisation, unfortunately as we don't have the whole picture we are unable to advise you. You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

Alternatively you could ask your MP for help, some MP's are pro-active and very helpful.
