hello everyone,
this is in regards PIP. My wife who claims this benefit, just spent 6 weeks abroad seeing her family after 2 years. before she left, we contacted DWP and told them the dates of being overseas (as we read thar is what you are suppose to do) and we got a letter a week before she was due home saying her award was ending and we had to reclaim. Also her payment wasn't received for this month (December), which was due two days before she came home.

We telephoned DWP. We was told to start a new claim by a case manager which we did and another person on the enquiry telephone number, told us he was trying update their system saying we had notified them of being back in the country but it didn't seem to update the system because we had started a new claim and it would go to a case manager.

The original claim was suppose to end in July 2022 and then it was extended to 2023. Now we are told to reclaim by January 2022. We also thought that if you are out of the country over 13 weeks then it stops!

can anyone give us advice about making a complaint about this and why this has happen?

You are correct in your post; you are entitled to PIP, AA, DLA during a temporary absence (defined as unlikely to exceed 52 weeks) abroad for:
~ the first 13 weeks; or
~ the first 26 weeks, if the absence is solely in connection with medical treatment for your illness or disability that began before you left GB.

AA Regs, reg 2; DLA Regs, reg 2; PIP Regs,regs 17 & 18

You have made it slightly more complicated in reclaiming, I would advise you to seek help from a Welfare Right Organisation who can look at all your circumstances. You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

How have I made it slightly more complicated in reclaiming? Can you please elaborate further?

Hi Geisha-Scarlet

It has become more complicated - because you followed the first thing you were told which was to put in a new claim. This information was incorrect. I'm sorry that we are unable to help you further. You would be advised to do as Gary suggested in his post and find a Welfare Right Organisation who can help you with the best way to proceed and look at your whole case. None of this is your fault. You tried to do the right thing! The fault lies with the DWP.

Hi Geisha-Scarlet, just to add to all the Mods' good advice, if I were you I would try to involve my MP. They should be told how the civil servants are abusing innocent citizens with misinformation leaving you without money you are entitled to. My sympathies and I know those of the rest of the forum too. And I hope your wife's family are doing OK, it is always hard when you live in different countries.
