Hi,
I can tell you this is part of the course that this has happened as the court will give a final decision.

The decision on this court case won't be finalised for a good couple of months up to 8 weeks plus, that's even before the DWP will more than likely appeal the decision which I foresee them doing.

I know one of the claimants that bought this case in the first place and he already said he will appeal this case again if the DWP do.

Apparently I've heard from the houses mouth the DWP are not even obliged to even pay it out it will only be possibly a small gesture if the loose the case?

I was formely known as (GoingOffMyHeadWithThisGovernment) Won PIP November 2017 ongoing award HR both. Now kept and got my ESA Support group but took a while.

I am in receipt of contribution based ESA and I am on Universal Credit (which I was forced to claim at the start of lockdown) Does this mean that I will be entitled to the ESA uplift if the court case is in our favour even though I have received the £20 uplift from UC?

Hi Moira

I doubt that you will receive the uplift twice, if the legal case is successful.

Nothing so far at all on the decision of this case, the hearing went on for a week towards the end of November and concluded well over a week ago.
I remember the Supreme court cases on judicial review cases on closing parliament and triggering Article 50 to leave the EU and all gave the result the same day with the government losing both. Why is this one taking so long?
