Hi,

I wonder if someone here can give me a more specific idea over whether 10 points for mobility is appropriate for my circumstances.

I've gone from a 2019 assessment where nothing was awarded, to an MR where 10 points were awarded for mobility under distress, to a tribunal where Daily Living Standard was also awarded. At no point here did I question the 10 pts for mobility, until the Tribunal when I stated that I was being advised that the high court had made a ruling around journeys but did not fully understand it and questioned the panel as to whether this would be reviewed.

No explicit answer was given at the hearing, but I again established in detail that I have been unable to go out alone, due to panic attacks, anxiety and other anxiety based symptoms since 2018, and that in fact New Years Eve 2018 was the very last time I went out alone, to the pharmacy, in an emergency because my partner and our three year old had been prescribed anti-biotics for serious chest infections. I needed collecting from outside the pharmacy, regardless, it was too much, and I couldn't cope.

The Tribunal awarded Daily Living around prompting to engage with others and preparation of food support and the same 10 points for mobility.

I keep being told I should be getting 12 points under this 'ruling'. PIP says I don't get a review because I I was awarded after the time period for LEAP, but I will be contacted if a review is needed.

I've asked the question again last month and been told to do a change of circumstances.

I've done this, and just had a phone call from PIP Consultation Centre where a pleasant chap wanted to check my form had been returned.

I've explained that there's really very little I can add, because there is no change to speak of other than increased medications, changed medications and the onset of Tinnitus as a side effect of medications - I'm simply pointing out that while I agree that I need the help of my partner due to anxiety and the related distress to leave the house, I actually couldn't follow the route of any journey alone because of that distress, panic and physical symptoms related to panic.

I'm assured I'll be called to discuss, but can anyone give me an idea as to whether I'm right to ask for 12 points given I'm effectively housebound without the aid of my partner (or on rare occassion my sister)?

We can't answer your questions as we are not assessors. Any claimant is entitled to ask the question and argue that they fit particular criteria and it is up to the DWP or sometimes a Tribunal to decide whether they agree or not.

If you have a look at our PIP guide it explains from the court ruling that if "e) (10 points) applies to you and you never undertake a journey because of overwhelming psychological distress, then f) (12 points) cannot apply because you would not be able to follow a route even if you had another person with you." (p78)
