Pip Tribunal was created by Justmehere
Dear all
I was previously awarded 13 points for daily living and 10 for mobility at tribunal.
Recently my pip came up for renewal I was awarded 0.
My mandatory reconsideration kept the award at 0.
I am now asking for this to go to tribunal.
It's an online form asking for my reasons. I feel overwhelmed by it as I don't want to miss any details. I will have to go through my MR letter and breakdown all my reasons.
Despite going to tribunal twice before (for ESA and PIP) I do feel overwhelmed again.
I also need to fund my treatment that my PIP was covering the cost of. I'm looking into grants and also considering permitted work.
With regards to permitted work, has anyone done it? What has been your experience.
Btw how do I search the forum to read old posts. I have been searching high and low for a search button lol. And how do I locate my posts. Again I have been searching high and low.
Thanks for all the great work. I wish I wasn't back here!
Best wishes
JMH

Hi JustMeHere
I'm sorry that you are facing a tribunal again. Have you got a copy of the assessment report - the PA4. I would hope that you had that when you put in for your Mandatory Reconsideration - but if you didn't make sure that you have a copy.
You can find your previous post by hitting on your name highlighted in blue on the grey sidebar to these posts
There is a search button at the top right-hand corner of the screen - next to a blue box with Members Guides in it.
You can search to see if other people have experience of permitted work - here is one post you might find useful

The DWP have called me today to try and resolve this before tribunal.
They have agreed to give me back my award with one change.
They are saying that I need prompting and not supervision with cooking. Note I was previously given this award at tribunal and she said there are no notes as to why that is.
She said you would need supervision if it was a safety issue or you had a cognitive impairment. And I said that basically rules out anyone with Mental Health getting the award.
I will lose a 1/4 of my award if I accept it at this stage.
Tribunal could be a year away.
She said I could think about it and she will callback in a few hours. I asked for a call on Monday which she agreed to.
This feels like good news because I was right in my application and right to fight my case. It's just alot to lose if I accept the award particularly because that funds my treatment.
I have to say this rather feels like a gambling situation.
For anyone faced with a similar situation I would say the DWP call is daunting but she was sympathetic.
I also think in hindsight I would have provided more details of a food/cooking diary..I did provide a diary.
I'm not sure what I will do. I am tempted to take the award at this point.

Hi Justmehere
From your post I have assumed that you will go from enhanced down to standard.
The first thing I would ask is, do you need supervision as awarded by the tribunal, if so why?
If you have a copy of your Tribunal decision they usually explain why they have awarded points, so have a look at your decision letter.
Only you can decide whether to take what DWP offer or go to a Tribunal.

Hi Justmehere /Gary,
When I was in a similar situation and received a phone call from the DWP making me an offer before tribunal I seem to remember my welfare rights advisor said accept what they offer on the phone as you still have the option to take it to appeal if you decide the offer is incorrect, There is no need to share your intention that you may appeal with the DWP advisor but it gets your PiIP back in payment and a little bit of time to decide on whether a tribunal is the way forward.
Perhaps you could advise Gary if I have remembered that correctly?

Hi Gaddy
Yes you have remembered that correctly.
I would just add, always seek advice from your local Welfare Rights Organisation.
