On ESA for approximately 12 years. Had savings/capital between the higher and lower threshold up until 5 years ago. Was wrongly advised the upper limit for savings being £3000, by third party org. Nevertheless, have kept DWP informed of decreases in savings fairly regularly, yearly as requested or at my own volition.
Have noted retrospectively, deductions spanning a couple of years while savings obviously well below the lower threshold. During this period, and just under a year ago, I received a one-off payment as result of court case, bringing me above lower threshold. I was informed on reporting this would make no difference to savings by DWP advisor. However, this turned out not to be the case, and regardless of falling below the lower threshold I am still receiving those same deductions. I have informed the DWP, and they admit, being in receipt for several months, of my correspondence detailing savings below the lower threshold. The entitlement letters received over the past couple of years including most recently continue to state savings above the lower threshold. In addition, the DWP are not following their policy for call backs, three requests allowing for the specified window have now lapsed without contact. Is it possible to clarify my actual position?

I'm sorry that you find yourself in this position. Your question is outside the scope of the forum. You would be advised to speak to a specialist benefits advisor and see if they can intervene on your behalf or involve your MP and see if they can gain a clearer picture. Otherwise, your only other option is to put in a formal complaint.

HI JeBa,

Different issue but I experienced the same problem of 3 requested call backs that never happened. I lodged a formal complaint over the telephone and I did receive a response and apology within a few days.
The matter was then dealt with fairly quickly.
Worth a try perhaps with a view to bring it to your MP'S attention should they fail to respond once again.
Its very frustrating I know, I hope you are successful getting a response soon.
