Bankruptcy and esa does it trigger migration to uc or benefit reassment was created by rig.jan@gmail.com
Hi. I'm still on ESA and I am also on Housing Benefit and get DLA. I have been on a Debt management plan for some time. With the rise in energy costs and living, I am unable to pay this going forward. I am considering Bankruptcy but am worried about the knock on effect it will have. Do DWP use that as a trigger to migrate to UC and reassess? I am really worried that that will also reduce my ability to pay bills if that happens, and am trying to hold off migration as long as possible. Not to mention the stress and worry of being reassessed. It's a worrying time for everyone. I have read that if you move house DWP get overzealous and use it as a reason to assess all your benefits, not just your housing benefits, which seems entirely unreasonable. I am wondering if they also do this if you go bankrupt , + change your bank accounts (as part of the process). thank you very much for your help.

Hi rig
Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is.
Welcome to Benefits and Work
I am not sure where you got your information from but it is incorrect.
Most claimants on a debt management plan have been wrongly advised, the vast majority of claimants I see who are in a debt management plan should have been in a Debt Relief Order unless they have an asset (car) worth over £2k and debts over £30k. The cost of a DRO is £90 whereas for Bankruptcy is £680.
You need to seek advice from a Money Adviser who is a member of the IMA, you can find information on National Debtline Website; www.nationaldebtline.org
Moving house does not trigger a move to Universal Credit, if you do not need to claim help towards your housing costs then you can stay for now on legacy benefits.
If you need help towards your housing costs and move within the same local authority then you stay on legacy benefits, you have to report a change of circumstances. It is only if you move to a new local authority and need help to pay towards your housing costs that you will have to apply for UC.

Hi Rig,
Just something else to consider relating to bankruptcy, if you plan to move home and will be renting then I think this could cause an extra headache trying to secure a rental property. In the South East where I am its really hard to find a landlord that will rent to any prospective tenant that is in receipt of benefits full stop. I suspect this discrimination is throughout the Uk but I was advised a few years ago that being a declared bankrupt would make finding a rental property even more difficult.
Best wishes,
Gaddy.
