Backdated lump sum payments was created by leew77
Hello,
Im trying to get some clarity about backdated lump sum payments.
How long do you get to spend them before they are counted as a part of your savings? Is it right that there are different rules depending on if the sum is over £5k? I cant find a definitive answer anywhere.
Thanks for your help and time

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Sausages
If your benefits have been underpaid you could be entitled to a back payment from the Department of Work and Pensions (DWP).
This might involve a substantial lump sum payment, which could push you over the savings limits for means tested benefits, including:
~ income-based Jobseeker’s Allowance
~ income-related Employment and Support Allowance
~ Income Support
~ Universal Credit
~ Housing Benefit
~ Pension Credit
In some cases, this payment is not counted as savings for one year and will not affect your income related or means tested benefits during this time.
However, where benefits have been underpaid because of:
~ an official error
~ an error on point of law
~ any payments over £5,000 can be disregarded for the length of the claim or until the award ends.

Hi
I have noted that according to our Housing Benefit calculations we have consistently been below the amount the Gov't says we need to live on since 2009. The gap has ranged from £32 to £218 a week. We have always provided Housing Benefit & everybody with all of our correct info so I don't understand why they come back each time telling us we're being underpaid.
Are the DWP really that inept??
Thanks
Clare

Mmm well I could hardly refuse Gary's invitation, could I?
I will now reveal that in the late 70's I was offered a job in the DWP. I did not take it because they needed about ten weeks to do security clearance or some such. In the meantime I got an offer which I took from a utility company [ie not high payers] for one and a half times as much as the DWP. Soon DWP phoned to offer me to start as a temp pending the clearance, as they were desperate.
There used to be a very un-pc saying about " you pay peanuts and you get......"
Yes there are some decent folk there possessed of both brain, and the integrity necessary to stand up to working for a biased system. But not that many in our family's experience. Sadly for all.
I do get irritated listening to endless news pontificating about 'restoring the £20 uplift' to help people cope with the cost of living crisis.
Some people never had it.

I should have said I'm in receipt of IB now ESA, support group and DLA now PIP & my daughter has been in receipt of DLA since she was 5. I was a single parent & had just my IB and Child tax credits for a long time. then my new partner, love him, bless him, squeeze him, moved in to be my carer & all he got was Carer's allowance. I've asked the DWP & quelle surprise, they insist I had everything I was entitled to.
