E.S.A & P.I.P. frustration. was created by trip77
This is going to very long winded so please be prepared for a good read and I hope I explain things well.
Here goes.
I have been off work since Oct.2018 with chronic tiredness, aches and pains in muscles and joints, and carpal tunnel in both wrists along with shoulder impingement syndrome, and 5 crushed discs in my spine, 2 at the top and 3 at the bottom.
I went through the usual rigmarole with GP's and consultants and was finally diagnosed with FIBROMYALGIA, chronic fatigue syndrome, degenerative spinal disc disease and osteoarthritis in OCTOBER 2020.
I applied originally for U.C and E.S.A when I finished work in 2018, and received the E.S.A. for 12 months before they stopped it in OCTOBER 2019. I had 2 assessments in that period, one for U.C capability for work and one for the E.S.A. capability for work during that period, but was never told what category I would be put into even after the 13 weeks was up for the E.S.A and I ended up having another assessment for UC., which I will go on about a bit later.
I applied for P.I.P in July 2019 and I had to go to tribunal to get awarded the standard daily living component, but no mobility, despite me telling them that I was in constant pain when walking anywhere, but also that I could walk more than 200 yards so I understand they refused me because of that.
I am now waiting on a tribunal outcome for the U.C work capability assessment nearly 2 years after first applying for it, I was also told that as my E.S.A. had ended in 2019, and despite not getting ANY reply back about the work capability assessment that I am no longer entitled to it and that they won't be pursuing the assessment I had to see if I would have been put in the support group, and therefore entitled to the ongoing payments if I had been found unfit.
I have had to fight and go to tribunal on every single application for a particular benefit apart from UC, and I have had enough of being pushed from pillar to post and not being told when I am supposed to be, on what I am or should be entitled to, or how my assessments have gone on. The worst thing about it is I hear from other friends and family who are in better condition than myself, applying for everything and having absolutely no problems with assessments or claiming the benefits they apply for. What kind of bloody world do we live in when people who need it most, get treated like shit and those who don't really need it, get it.
I have had countless letters from consultants, GP's, and my employers occupational health assessor saying that I am unable to work and that my condition will be lifelong and won't improve and yet I am having to fight with nail and tooth for everything I apply for.
Where is the justice in that??

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi trip77
I can feel your frustration in your writing and you do have good cause.
The first thing I would say is have you contacted your local Welfare Rights Organisation or even Law Centre as they will be able to take all your information to give you accurate advice.
You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk
All Law Centres specialise in social welfare law; www.lawcentres.org.uk/i-am-looking-for-advice
