Hi Folks

I have phoned the wonderful DWP this morning regarding my first time review which I submitted 6 weeks ago to be told that it is waiting for an assessment. I only had my award as a result of going to tribunal and the thought of this again fills me with dread. However i know we have to play the game my question relates to assessor’s ability to deal with fairly rare conditions. I suffer with Chronic Cluster Headaches which not every medical professional has come across.
1. Do we have the right to ask what specific knowledge of the disability an assessor has?
2. If offered a telephone assessment should I consider accepting
3 Can I request a home assessment?
4 Can I record the assessment do I have to inform them?
5 Does any line else have experience of requiring an assessment following a tribunal award..

Hi Neil

I will try and answer your questions but you have not said which benefit you were being reviewed for, I will assume it is for PIP as you talk about your condition.

1) When you apply for PIP, it is not about your condition but about how your condition affects you. The assessor should have read your application and then ask you questions based on your answer, this is why we advise claimants to explain why you cannot do something or why you need help to do something, the why is the important part.

After the assessment, if you ask DWP for a copy of the assessment report it usually tells you the proffession of the assessor.

2) Only you can answer this question, if you have lots of supporting evidence then you could request a paper assessment, they have started to do Face to face but only under certain circumstances.

3) I am not aware that they have started to do home assessments again.

4) Yes You can legally record a telephone call without informing the other party providing the recording is being made for your personal use. In fact, do not tell the assessor that they are being recorded as they will likely terminate the assessment.

5) I would say virtually every claimant who has won at a tribunal has had experience of requiring an assessment following a Tribunal award.
