Advice on Mandatory Reconsideration

Can anyone please advise how long it takes for a decision on a mandatory reconsideration. I contacted the DWP 2 weeks ago to check that they had received my letter to be informed that they had and it was with a decision maker. I was awarded 0 points for both daily living and mobility and decided to ask for a mandatory reconsideration due to the HP’s report being very misleading and not factually correct. My concern now is I am 65 in June and was wondering whether the DWP would still consider my application (my initial application was made to the DWP for PIP in December 2021 following an injury in February 2021) or whether they will wait until I’m 65 to inform me that I’m not eligible for PIP. Just for information I don’t get my state pension until June 2023 when I will be 66. Thank you any help would be much appreciated. I find this forum invaluable and I would have really struggled to put a mandatory reconsideration in without the help and guidance on this site thank you.

Thank you for your kind words, unfortunately we cannot give you a timeline as to when you will hear about your MR as it varies from region to region, since Covid there is a backlog which has exacerbated the situation.

To be eligible to claim PIP you have to have a condition for 3 months before you claim which is ongoing for 9 months plus, so yes DWP would still consider your application.

I can't see why DWP would wait until you are 65 as 65 is no longer state pension age.

Depending on your circumstances you may be entitled to claim Pension Credit when you reach state Pension age: www.gov.uk/pension-credit

Thank you everyone for your support and advice. I have now received the mandatory reconsideration notice and unfortunately they have said they cannot award PIP for daily living or mobility. It is very disappointing as I felt I had provided a lot of evidence. Any advice now you can provide regarding an appeal I would be grateful. I will also have a look at the guides on the forum. Hi Joan

I am sorry this has happened to you.

When you put in for your mandatory reconsideration - did you have a copy of the assessment report - it's called a PA4. If you haven't got it, you would be wise to ring the DWP for it as it should give more detail of why you have been turned down. Obviously if you have it - you clearly disagree with it and you need to show that at the Tribunal. A lot of people find their Mandatory Reconsideration remains unchanged so you are not alone.

The first thing you need to do is lodge your appeal within one month of your MR decision letter. There are three ways you can do this and they are all explained in the Guide to PIP appeals. The information is from page 8.
