Hi
I may be missing something (not unusual) but I don't quite understand how getting state pension would mean that it would not be possible for a PIP increase if circumstances deteriorate?

“Submitted my renewal for PIP which was received by DWP on the 11th May. I followed the guides as I am due to receive my state pension soon and was made aware by the advice on this forum that I would not be able to get any increase to PIP after this.

Hi Lawson

It's the rules that once a person reaches state pension age their PIP stays the same regardless of their situation. It seems unfair, but when PIP was originally spoken about they were going to stop it altogether for everyone. Now a person can't make a new claim after the state pension age but those on it will continue on it.

Thanks very much Bis. I have obviously dropped the ball on this. What happens if over state pension age on DLA (both higher rate) and you are then asked to apply for PIP?

Hi Lawon

Anyone born before 8 April 1948 is due to stay on DLA indefinitely. Allegedly everyone else will be migrated across. I think the idea is that everyone will be moved across in time (but who can tell with the DWP?)

Just to clarify.

If you are currently receiving DLA then the Transfer legislation allows you to receive a full award of PIP even if you have passed State Retirement Age when the Decision is made.

If you are already receiving PIP at SRA then the Mobility component cannot be awarded if not already in payment or increased if you are only receiving the Standard rate. The Daily Living award is not restricted.

If you report a Change of Circumstances before SRA then any updated award should be backdated to the date you informed the of the Change, allowing an increased Mobility award if applicable.

If the DWP initiated the review then it will depend on when the Decision is made.

Thanks Bis. Yes was aware of the 1948 cut off - not applicable in this instance (for once would be helpful to be older for him). So it seems that if succesfully transferred from DLA to PIP (both higher rate) it should be for a longer period with the so called light touch? I suppose it also depends on the "popular Policy of the day". Thanks again Bis
