Pip Appeal was created by Nikki-White
My advice service has made an appeal on my behalf for pip after I was rewarded 0 points at both the review and MR stage.
The DWP have until the 22nd of June to respond.
However today I have been officially diagnosed with Fibromyalgia, I mentioned about my chronic pain in the review and how it affects me but only today have the official name.
I am also due to see the Adult Autism Team soon
Can these be brought up at the appeal as I had the symptoms but never the official diagnoses?
What is the best evidence that I can take to the appeal, I try reading your guides but I get confused and have no idea what I am doing
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Nikki-White
You already brought up your pain at your review - so it is relevant at your appeal. Because you did not have the diagnosis at the time of the review - they may just accept it or argue that you will have to put in a change of circumstances.
You can inform them that you have been referred to the Adult Autism Team - but it will probably make little difference to the panel as you have yet to see them.
I can't tell you what evidence you need to include for you, because I don't know you or anything about your medical condition and how it impacts your life as per the PIP criteria. If you're struggling to understand the guide - you need to try and find someone who can help. I know this is not easy. If you don't have friends or relatives who can help you could try and find a specialist welfare advisor in your area who could help you put in an appeal? I have included a link advicelocal.uk/

Hi Nikki-White, if you wish to mention your autism it would be best to make very clear that the problems it causes you with PIP descriptor activities [eg interacting with other people perhaps] have always had the same effects and always will, because autism is a lifelong condition that is not 'caught' like an infectious illness eg Covid nor is it 'acquired' like say a head injury from a fall causing brain damage. And autism cannot be treated or cured either, just perhaps-but-not-necessarily learnt to live with.
The assessors likely do not know this; it is said one once asked a claimant when they caught Down's Syndrome!
I guess eg noise-blocking headphones could count as an 'aid or appliance'?
Best wishes,
Denby
[also waiting for my assessment for Asperger's]

I have an appointment with the adult Autism team tomorrow
I sent in the referrals for my mental health support which I am now getting, the adult autism who I see tomorrow.
Also sent in proof that I was awarded a blue badge before the decision was made and sent to MR
The Fibromyalgia Is new, but I did mention about my pain and back spasms.
I never got pip cause I can drive, went to further education and some other stupid stuff
I’m guess I’m just worried it will be the same at the appeal stage, my advice centre is trying to get medical support from my doctors.
I did record my assessment.
But I just feel really lost with it all, as they won’t fully contact me till nearer the appeal so have no idea what I may need or what will be useful
Sorry to overload but I’m in pain and just not got the energy for it all

Hi Nikki-White
I can't pretend that the appeals process isn't daunting but you have a much better chance of winning on appeal that you have at the mandatory reconsideration stage because there will be a medical expert on the panel and a disability champion who will have more understanding of your conditions/s
Driving will come up at your tribunal and the DWP has been known to argue that if someone says their condition prevents them from doing things at home, then they are not well enough to drive and should inform the DVLA immediately. However, there are also plenty of people who have PIP who also drive. I can't tell you what to say, because only you know your condition and how it affects you, but you want to include how often you drive, and how often you are stopped from driving. Explain why you don't use public transport. There are also people who have PIP and go to college. I don't know if this is recent or a long time ago -but again you need to counter their arguments.
I can't tell you exactly what will be useful, but once your case has been submitted to the tribunal's service you can always add additional information. That is explained in the guide when you are up to taking a look. It's a much shorter guide than the general one.
