Hi
I have received my MD and it is still the same, so, because some of the reasons why I shouldn’t get the daily care appear to be unlawful and, they have told me that because I can hold on to handrails I don’t have arthritis in my hands
I have just been reading through some things and it says once the forms are submitted to tribunal, they send my forms back to DWP to see if they want to change their mind, is this the case, thanks all for your advice with this

The statistics of being successful at the MR stage is quite low and most claimants who go on to appeal are successful.
When you appeal, which you can do online, you put in a submission. I usually use the assessors report to base my submission on. I go through each descriptor stating what the assessor has awarded and then I write what I believe should be awarded and ........... why
The why is the important part especially if you can tie it in with any supporting documents, having arthritis does not stop you gripping on to something but it can cause you pain, so if you go up stairs holding on to a handrail to pull you up the stairs to the toilet then make the explanation, work through all the descriptors.
The appeal form will be sent to the DWP, the DWP will issue a bundle of documents, the same bundle will go to the Tribunal. The DWP can at any time contact you and make an offer. I had a client a few weeks ago who took up the DWP offer of standard rate for both components, I thought we had a good chance of enhanced for both components but it was the clients decision and she was happy with what she was offered, it was also backdated 18 months along with her IR ESA SDP premium.

Thank you Gary for all the information, I have read lots and lots of guidance on this site, as well advice from yourself and others
I truly believe that the DWP will twist everything you tell them, even though they are supposed to be helpful to people throughout the whole process
I also think that some of the reasons they have given me are just untrue
I drive a manual car as least as possible because it hurts so much but, if I didn’t use it I would be housebound
