Hi,
My brother has scored the standard 0 points for a PIP claim. The decision maker’s rationale is quite extensive. It relies heavily on the HCP report and does not seem to factor in the psychiatrist’s and occupational therapist’s report that were submitted with the PIP2 form. The references to the HCP report contain excerpts that are incongruent with my brother’s retelling of the assessment.
When making the MR, how does one challenge the HCP report without a copy of it? Is it possible to obtain this prior to submitting the MR? With the timescales this seems impossible.
All help and advice appreciated.

Hi Ka
You absolutely can get hold of the report. Rong the DWP and ask for a copy of the assessment report. It is a PA4. This should arrive 7 - 10 days after your request. You need to put in a request for your Mandatory Reconsideration - within 4 weeks of the date on the decision letter. So depending on when you received the decision, you don't have to put in a request for the MR immediately, but don't leave it too late. People have been offered extensions to putting in an MR, but you must ring in plenty of time.

Hi Ka,
In the MR, debunk that nasty report icy coldly, never using the word 'lie'. Go for things like 'has overlooked' 'appears to have completely ignored' 'has failed to note' etc. And refer back to all the evidence for each point-losing section.
You can if necessary submit an MR before the deadline saying that you will submit further evidence as soon as possible [ie after the deadline] and do so, just be sure that every page of every stage has his name and NI No along the top, and eg Page X of y.
