Pip MR and query about length of time for revision

I am in a similar situation, but worse, as I was greatly harassed at time of last assessment, and although preparing an appeal, I was too exhausted and weak, close to death, and being badly harassed with little support. Then Covid came, and 6 years has passed, in which time I have been out of it in bed, barely eating. Then I called Social Services and they put me in touch with benefits advisers, but they don't want the whole case, they did just did most of my form.

Now my renewal has come, but I wish to ask them to look at the previous decision, as the assessor lied, which I can prove, and I have letters of old, and former claims, that point towards my being awarded higher than the standard rates he gave me. I may also benefit from the change of law to the meeting people, I shall check.

From what I have read I may have to ask for an any time revision, and focus on the specific point that he misled the case worker, who was therefore in ignorance of the true facts, and I have some letters that should back this up. Will the DWP let me open this up ln relation to how I address this initially, as I could ask for a mandatory over last 13 months, although I feel impelled to go back the whole 6 years, as these people nearly killed me, not least through reduced care due to less money. Then, there are supersessions, with smaller rewards.

And what is the chance of taking this to a tribunal if they are obdurate, can all revisions go to a tribunal? I note that MP's can be used, and the Ombudsman if needs be. The issue that caused trouble I think is a letter from a neighbour who he wrote to, despite him knowing next to nothing about me and my illness, and he has been threatening to destroy me and my benefits for years now, even inciting people to smash my flat up, although he seems very sensitive and intelligent when you first meet him. Thus, I do not bother with him now, and consider this a police matter in some ways, yet the assessor has coerced with him, I feel it n my water, and I shall ask the DWP for any evidence on my case on the last assessment. I had asked this chap for help when I tried to cut a squash, and decided to use this as evidence of these issues, and why normally I do not cook.

Any thoughts, please, including whether it is worth finding a solicitor to help me?

I'm sorry that you have had such difficulties with the DWP that has impacted on your health. If you want to raise issues that are six years old - you can only do this through the complaints system. You can find a link here: benefitsandwork.co.uk/guides-for-claimants/faq/general

If you go through your appeal - they will only deal with, your current award and the mandatory reconsideration. The aim of the tribunal is to decide whether or not you meet the criteria of PIP.

You can ask the DWP if your case can be looked at due to changes in the law. They may tell you that this has already been done without you knowing it.

I can't advise you about whether you should get help from a solicitor. That is a question that is outside the remit of this forum. You would need someone who understands the benefits system.
