Hi there ,
Slightly confused ,
I recently had to claim universal credit due to house move, husband works I recieve esa contributions based support group , and pip standard care high mobility
I also have a 14 year old child who has been on receipt
Of child dla for many years
Here’s the anxiety , when I filled in the universal credit forms a benefit advisor said I should put I care for my child as I do there my child despite having health problems my self and I should put my husband cares for me which he does despite working
My husband has been given cares element of universal credit I haven’t been given the carers element but it’s on the form I care for my child , I haven’t been given carers element as I have been given the low
Capability for work element apparently you can’t have both
Question even though I haven’t been given the carers element will it still be there as unpaid entitlement , meaning will this affect my pip and esa , I don’t get carers allowance , just put down I care for element of universal credit . I’m now very anxious , this is my child so I do care for them because to say otherwise would be like saying I can’t have a child with a disability because I get disability benefits myself , however , should I be informing esa and pip of this and will they view this that I shouldn’t have my esa or pip awards , I only ticked caring box because benefits advisor said I was entitled and I’m not because of esa capability element after all that

Hi Chrystal

You have a number of things going on, you may want to contact your local Welfare Rights Organisation to get a full picture; advicelocal.uk

Your CB ESA and PIP will not be affected , I would question why you have not been given the LCWRA element as you receive CB ESA and in the support group, you therefore do not have to complete a WCA form.

I would contact your WRO, who can then take your circumstances into consideration to give you advice.

Hi Gary thank you so much for replying , they have given me the low capability element , I think I’ve confused things so sorry , I’m worried that even though they haven’t given me the element for caring for my child , which I understand is because of receiving the not being able to work element , I’m anxious that my pip or esa contributions based could Suddenly get taken away because I have told universal credit I care for my child who gets dla. If they asked me they would understand what I do for my child is different to the help I need for myself, could I suddenly have my pip or esa removed for caring without an assessment . Sorry I hope I haven’t confused things

Providing that your condition has not changed for the better from when you were last assessed, then I cannot see a problem.
