Successfully suing dwp, atos was created by Elizabeth
Can anybody confirm whether they have successfully sued dwp and or atos for negligence in relation to a pip claim that is brought a civil claim in the county court

I do remember reading about someone on the forum who was successful but that was a while ago, you could try and do a search in previous posts.

Hi Elizabeth,
Have you exhausted the internal complaints system first?
Have a look here:

It is possible to get compensation via a complaint or review by the Independent Case Examiner. You do normally need to have finished internal complaints etc before you are allowed to apply to the court.
If you wish to complain about something that DWP should have done which they haven’t eg processing a claim which hasn't been done, or paying benefit when a PIP decision notice awards over 8 points for daily living. In these examples you would probably wish to threaten judicial review. ( This is definitely something only for a solicitor to actually do as its highly technical.)
I suspect if you are planning g any legal action a visit to a solicitor would probably be a very good idea!
