DWP phone offer before tribubal was created by M
Hello,
My PIP case is currently at the appeals court stage.
If the DWP give me an offer over the phone based on new evidence I submitted, but say they just give me enhance daily living but standard mobility and I feel like I should get enhanced mobility, what do I say to them on the phone?
If I say I disagree with that will that mean I won’t get any of the funding at all that they’ve suggested until I go to the court appeal hearing? Or can I disagree and they still give me the money but the mobility rate remains as the standard rate? And then the courts decide on if I get enhanced mobility they back date it?
I hope that question makes sense sorry for any confusion

You can try and haggle with DWP for the enhanced component by quoting supporting documents, we have come this situation on several occasions from members on the forum.
If you accept what the DWP offer then your appeal will lapse, once your PIP is in payment you can make a new appeal, but remember you can loose what you have already been awarded. If you did go to the tribunal and won then your claim would be backdated. The tribunal will set the backdate date.

Hello Gary. Am I right in thinking that M could accept the DWP's offer and at least receive some benefit, but if it's not what was expected M can then submit an appeal on the offer the DWP made prior to tribunal but still receive benefit while the whole appeals process plays out?

Yes, but there is a risk that the tribunal could make an adverse decision to what DWP offered.

Hi, does the tribunal need to warn you if they feel your award may be reduced so you have chance to withdraw your appeal ? Best wishes

I believe you are correct, it is something I have not come across myself at a tribunal.
