Hello,

Last year I phoned the ESA help-line and was told that my eligibility for ESA is due to be reviewed this year. I'm wondering if, like PIP, there is a review version of the ESA form (eg one that asks if anything has changed, etc), which is different from the original ESA50 form? Or will I have to apply for Universal Credit instead? I'm in Brighton, East Sussex (in case that's relevant re ESA vs UC)?

Hi Faith

You have not stated which type of ESA you are on as there are 3 types.

ESA is an indefinite award with scheduled reassessment based on the Prognosis Date completed by the assessor in their report, so your existing ESA award continues in payment until a new Decision is made.

New Style ESA is a Contribution Based benefit and is not means tested with the exception of pension income which can reduce the amount that you receive.

The Income Related benefit that goes with NS ESA is Universal Credit.

I am not aware of a ESA review form, have a look at our new September guide; url=https://www.benefitsandwork.co.uk/guides-for-claimants/esa]help-for-claimants/esa1 [/url]. If you kept a copy of your previous application then use that as a guide and make amendments if your health condition has deteriorated or improved.

You will be sent a new ESA50 form to complete if you are in receipt of legacy benefits, if you are in receipt of NS ESA then you will be sent a UC50 form.

Both forms are exactly the same apart from the name

ESA reviews are largely still on hold at the moment due to massive backlogs in the system and the need to prioritise Work Capability Assessments for new claims, not only to ESA but also for anyone who has claimed UC on the grounds of illness (the same assessors undertake assessments for both ESA and UC as the assessment is the same).

You might find that your WCA date has been put back 2 years. It appears to be an automatic process, when the WCA date on your claim is reached it is automatically forwarded by two years. This has been ongoing since Covid hit in 2020. I was due to be reassessed in September 2020, this was automatically changed to September 2022. My reassessement is now overdue and I'm expecting (hoping!) it has been deferred again.

The review form is a standard ESA50 form.

Thanks Gary.

Sorry, I don't know anything about the different types of ESA so I don't know which type I'm on. However, I've been receiving ESA since 2013 so I guess it can't be New Style.

The link didn't work but I did find the new (September) version of the guide. Very glad you mentioned that there's a new version now.
