Hi

Im registered disabled I have been awarded PIP high rate for both care and mobility ongoing rate. I was employed working part time from home and on UC. UC was topping up my salary monthly. My job ended end of June 22 and I was too sick to work. I own my own home which i live in, I bought it 3 years ago I declared this and I bought another home through my Limited company which i rent out to tenants in May 22, the limited company owns the house not me I am the company director.

When my job ended june 22 I told UC that my job has ended, I am too sick to work I have a sick note and that i have bought a house through my limited company that I rent out to tenants, so I ticked self employment. UC called me from self employment department I advised that I have never withdrawn any money from the rent and all the money I received has been used on repairs on the property, and that I don't intend to draw money from the house in the future. UC said the house is still classed as mine even though the company owns it not me. UC said they will not put me down as self employed I do not have to send any rent or payment details in, as I do not withdraw the money from the rent however as I have a second house they will refer me to the decision maker to see if they will class the second house as capital which will affect my UC if they do. They said i have to fill in a A64A form, then the decision maker will decide. The house is worth £139000.

In the meantime they have not given me any money they stopped UC from 30th June 22 they have never asked me to provide any sicknotes. My tenants all moved out 14th August 22 I didn't get new tenants until 23rd Sep 22 so had no income from the house and now I have got tenants I had to refurb the house so had to pay the builder all the rent money and add to it myself from money i borrowed. I assume if they take my second house as capital I will not be entitled to UC as over the threshold.

Before I bought the house i called UC and asked how this will affect me they said that I am entitled to full UC for 1st year of self employment with no minimum floor income as I am disabled. So I was told that as the person in UC self employment has now said Im not classed as self employed this is worst for me as if they say they class my second house as capital I am not entitled to UC, so I was told the UC lady made a mistake when I researched it online.

I haven't sent the form back yet as my grandad passed away and I have been extremely sick due to my illness. Im concerned if I send form back and they class my second house as capital I then wont be able to change to self employment without some sort of appeal and I honestly do not have the strength for that.

Can you please advise me of the best thing to do? Or what you think the outcome will be or the pros and cons.

I can feel your concern, we have over the years had a few enquiries such as your, unfortunately they are outside the remit of the forum.

You need to get specialist advice from your local Welfare Rights Organisation or Law Centre where they can take all your circumstances into consideration; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk or lawcentres.org
