How long can you leave for a holiday and not have it affect your benefits.

Hi Miss Taffy

It would depend on which benefits you are talking about.

It is 13 weeks for PIP and 4 weeks for ESA. The day you leave and the day you return should not be counted. See

www.gov.uk/claim-benefits-abroad/disability-benefits

If the claimant is only receiving Contribution Based ESA then the claim is usually suspended if the claimant exceeds the limits, if you are only receiving Income Related ESA then the claim will be closed and as a new claim would be required, this may require a claim for Universal Credit.

The law on this is black and white on this subject, so if your absence extends to more than 28 days even if it was originally planned for less, then, your ESA stops.

Hi Miss Taffy,

I'm afraid the DWP don't like claimants having holidays.

They seem to think that if a claimant can go on holiday, they are fit enough to go to the moon and back and carry out all general and complex maintenance duties on the shuttle during the trip which on the balance of probabilities, would not be an unfamiliar journey.

Seriously, it's a case of not observing their much abused stance that not every disability is visible. In other words; in the tone of Booming Boris during the pandemic, 'you must stay at home' (or not from it).

Regards,

Phrank.
