query re eligibility for IR ESA when on Cont ESA was created by shwmae
Hello - I'm on Cont ESA and was assessed for IR ESA - I initially qualified for a very small IR ESA top-up due to my savings, but a friend died and left me £1k which put me over the top-up limit. My question is - I am still way under the £16k threshold and still having to tell them my savings every year - does this mean I still qualify for free dental and eyesight test? Or does it go by receiving a top-up? I had a recent dental check up and wasn't sure so I did pay. Thank you.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi shwmae
it does not matter how small the top up is, if you are in receipt of a qualifying benefit then you will qualify for free prescriptions. If you have savings between £6k and £16k then for every £250 bundle you loose £1.00pw tariff income.
You may want to seek advice from your local Welfare Rights Organisation advicelocal.uk

hi there - sorry- looks like I didn't explain very well- oops. I did lose my IR ESA top-up correctly- my savings wiped it out with the addition of that bequest from the Will. But as my savings are still under £16k and I still have to let them know about savings, does that mean i still qualify for free dental etc- (am in Wales so we don't pay for prescriptions. ) I know I can't get a top-up even though my savings are way under £16k- but does that mean I have to pay for dental and optical check- I don't need to check about eligibility for a top-up as I did have one and correctly lost it - but because they still have to check my savings are under £16k what does that mean regarding dental etc? (I am Cont Based ESA but did get assessed for the IR ESA as well. ) Sorry for confusion -Thanks.

Hi shwmae
I cannot give you an answer as we do not have all the facts, if you do not receive IR ESA then the answer is no, as stated previously you do need to seek help from your local Welfare Rights Organisation who will be able to take all your circumstances into consideration.

I have found out the answer - I had been confused by the upper amount of £16000 but as I only qualified for the lower premium due to being on PIP then my IR ESA top-up was cancelled out by my savings despite being well under £16000. It seems that people just on CB ESA can still be sent a request for savings declaration if no longer entitled to a IR ESA top up but were previously- it is so the claimant doesn't try deprivation of capital to try and obtain the IR ESA top up again- which makes sense now- hope that helps anyone else in same situation- at least I now know I was correct to pay for my dental check- always best to play safe if you're not sure of entitlement. Thanks again.
