Hi guys can anyone answer this query I can't find a definite answer anywhere
Here goes
Father and son lived in a council house for years they both bought the house outright in 2013
Son is on income related esa support group his partner moves in 2015 she moves out Feb 2017
Son then is awarded Pip in March 2017 standard rate care enhanced mobility is the Son then entitled to the SDP
Any advice would be helpful

Hi lochpike,
Son receives standard care PIP and means tested ESA this is the entry requirement.
It is not clear from what you say whether the son still lives with his Dad. Normally you can only get SDP if you live alone without a carer. If you only live with other adult disabled people who achieve standard rate care or equivalent then you still might be eligible for SDP.

Hi thanks for reply Son still lives with father spoke to cab there is two lines at the bottom of a paragraph from cpag book stating father might not be classed as a non dependant due to Co ownership Im baffled what the last line means is it from the date of the claim

Hi lochpike,
I have a feeling that the comments about non dependant relates to housing benefit or housing costs under UC. Basically, if you live with other people who have their own income, so don't depend on you, it is assumed they should contribute to the tent and hence UC/Housing Benefit is reduced by a set amount. People who get PIP, or equivalent benefits or people who receive means tested benefits in their own right, eg an adult child are not considered non dependant for these purposes. Since this rule relates to housing this may explain the reference to co-ownership.

I have just checked the Disibility Rights Handbook edition 47 page 133

Living alone

The following are not classed as non-dependants and their presence in your home is ignored:

~ anyone under 18
~ anyone 18 or 19 who is part of your family and is a 'qualifying young person'
~ any person (and their partner) who is not a 'close relative' of you or your partner and 'jointly occupies' your dwelling asa co-owner or is sharing legal liability to make 'rent' payments - a joint occupier, eg a joint tenant, cannot count as a non-dependant.

If a co-owner or joint tenant is a close relative of you (or your partner), they will count as a non-dependant (and so exclude you from the SDP) unless the co-ownership or joint liability began before 11.04.88 or by the time you and your partner moved in.
