Esa and holidays abroad was created by micksville
Would a trip to Germany to visit my sister whilst I am o ESA support group mean my claim would be stopped or suspended ? It would only be for a week or ten days. Also could it be a cause of my having to make a claim for universal credit upon return?
I visited her some years ago and notified the DWP that I was going and also the address and the assistance I received at airport etc to demonstrate there was nothing in making the trip that would contradict my reasons for being on ESA or DLA as it was then ( I am now on PIP). I seem to remember the rules were different if one was travelling outside the EU, which we were members of back then of course. If the country visited was within EU thus having a reciprocal agreement with UK the rules were rather more relaxed than if travelling to Canada or Australia etc. I wondered if now we are out of the EU, there are tighter restrictions on leaving the UK even though it is for less than 28 days and to an EU country.

Hi micksville
It is 13 weeks for PIP and 4 weeks for ESA. The day you leave and the day you return should not be counted. See
www.gov.uk/claim-benefits-abroad/disability-benefits
If the claimant is only receiving Contribution Based ESA then the claim is usually suspended if the claimant exceeds the limits, if they are only receiving Income Related ESA then the claim will be closed and as a new claim would be required, this may require a claim for Universal Credit.
The law on this is black and white on this subject, so if your absence extends to more than 28 days even if it was originally planned for less, then, your ESA stops.
If you go abroad, you can continue to get Universal Credit for one month.
You must:
* be eligible for Universal Credit when you’re going abroad
* remain eligible for it while you’re abroad
* tell your work coach that you’re going

I'm pretty sure I'm on a combination of contributions based and Income Related ESA (Long Story) The link you posted seems to only cover disability benefits PIP ad DLA but am I right in thinking that you are saying the ESA claim would stop if on IR ESA, regardless of amount of time out of the country or only if you exceed the 4 weeks limit?

Thanks Gordon. I thought so I went away for 2 weeks some years ago and informed them, nothing happened to affect my claim. I just wondered if anything had changed as we have left the EU since then

Hi Gary,
I'm also on Supported Group CB ESA. Does your reply mean that if a claimant is going away for less than 4 weeks they don't need to inform the DWP?
Is it any different for a claimant in receipt of DLA at lower/lower rates? What are the rules on foreign travel in that benefit?
