Hi all,
got a potentially confusing one, seems a bit niche so thought I'd ask around around if anyone had any knowledge / experience.
I've applied for both UC LCWRA and PIP, both of which obviously ultimately come from the DWP.
For UC LCWRA, I had an in-person health assessment with a DWP nurse, who made the decision that I should be put in the LCWRA group. So that is now on my UC claim, and I am receiving UC payments on that basis.
With PIP,
I'm at the 3rd stage now (appeal).
I've submitted my appeal, but don't have a hearing date booked yet.
What I've noticed looking through all the paperwork that gets sent to all 3 parties, is that the DWP nurse who did my in-person assessment for Universal Credit considers me very disabled / entitled to be in the LCWRA group,
but the PIP assessor who did my telephone assessment for PIP considers me basically not disabled at all, and not entitled to any PIP.
That in itself is kind of whatever, I wouldn't expect them to always be the same, and it's different people doing the different assessments etc, but I'm wondering if anyone knows / has any experience of whether
it's possible that if the tribunal ultimately agrees with the PIP assessor that I shouldn't get any PIP, the DWP could retroactively void / overturn the UC nurse's assessment and undo my entitlement to Universal Credit LCWRA.
I hope that makes sense. It seems unlikely, but yea it's a very complicated system....

Welcome to the forum.
You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum
PIP and LCWRA are different benefits which look at different aspects, LCWRA is about work whereas PIP is about how your disability affects you.
If you look in the guides tab under PIP you will see; UC/ESA and PIP overlap which will explain the overlap.
What I usually do is send in a copy of the award, as you have been awarded LCWRA, then I would include a copy of that in my claim/MR/Appeal.
Don't forget to use our guides to help you, they are easy to understand; benefitsandwork.co.uk/guides-for-claimants/pip

Hi Gary, thanks for the info,
I have downloaded the UC/ESA & PIP overlap guide as you suggest.
I've actually already submitted my appeal, I'm now waiting for the hearing date to be booked, I also have the "bundle" of all the documents that (I assume) get sent to myself, HMCTS & the DWP in advance of the appeal, and the UC LCWRA assessment is already included in that bundle.
Would that mean that I don't need to send the LCWRA award, as they already have it (as it's in the bundle that was sent to me)?

You are correct. Thre is no need to send a notification of your LCWRA, as it is already included in the bundle. You have the same bundle as has been sent to the panel.
