Nothing on this board constitutes legal advice - always consult a professional about specific problems

I telephoned the DWP about my Christmas bonus which I never receive and they ended up doing a benefits check and suspended my ESA. I had a single claim for ESA and received Disabilty premiums and carer premiums. They stopped my ESA because my partner is 69 and over state pension age and I am under pension age. He was invited to claim his pension in 2018. We asked the DWP what we needed to do. They said to contact pension service who said he could defer as long as he wanted so he deferred after we took advice and told if he claimed state pension we would be put on universal credit and we didn't want to do this.
The DWP said he should have been claiming his pension. They have stopped £185 per week from benefit despite the fact that even though he has claimed the pension five weeks ago he hasn't received anything and there is no time scale for when this will be processed. The DWP have stopped £185.00 even though the Pension service haven't told him what amount of pension he will receive.
Is this allowed. Can the DWP stop money he isn't receiving yet? They have also stopped carer premium for him. We care for each other they said he cannot have a carer premium as over 69.
We have £100 to live on and cannot afford to live. There is nowhere to get advice as no-one does benefit advice where I live. Everywhere I have asked for help I get totally different answers.

I'm afraid, based on the information in your post things may be worse than you think.
Your ESA is likely suspended rather than stopped, this is not because you are a mixed-age couple but rather due to your partner's pension.
The DWP is entitled to assume what is called Notional Income for certain things even if these are not currently in payment, one of these is your partner's pension.
The £185 sounds excessive and you may be able to argue that this figure should be reduced once you know what the pension will be but if your partner was eligible to take his pension in 2018 then there will be a considerable overpayment (4 years?) of your ESA which will be recoverable.
You say that you can't get advice but I urge you try and do so even if requires travelling, this is a serious matter and we can only provide limited advice on the forum.
Have a look on the following for help.

Further to my post. I have found out that £77.70 pw was deducted last year because we are caring for each other. I don't understand why this was stopped as we do care for each other still plus the carer premium of £40 for caring for me. £185 iOS deducted for partners state pension. I cannot understand why I am having notional income removed back to £185 at the time I contacted both ESa and pension service. Esa said to ring pension service pension service said they could defer pension. As for benefits advice there is none. Going to next /another town no good as not in that area so no funding. There is nowhere mp won't help. I even pay £12 per month for a so called VIP benefit advice but they have ignored me. A statement of advice has been received form pension service which is blank with no money showing. Pension service just say they will send an email to the Department. Everyone I ask for advice seems suggest I am a benefit cheat for not drawing someone else's pension. It was precisely for this reason and not getting any money that they didn't. There is no benefit advice and no I don't understand any of it plus I have mental health problems autism and adhd not to mention physical health problems

Hi wolfchile
I have answered your question in your previous post; www.benefitsandwork.co.uk/kunena/10-dla-...d-aged-couple#276827
As Gordon previously answered if you defer your state pension then it will be classed as notional capital when looking at other means tested benefits.
