Telephone assessment can I refuse yet another appointment? +New medical reports was created by MuttonJeff
Hi,
What will happen if I refuse to book a further assessment if my next one gets cancelled or goes wrong yet again? I had an hour and half today so it was part done, but most of that time was waiting for a call back as their phone kept cutting off! Scenario below:
They gave me a face-to-face appointment at 9am rush hour in a city over an hours drive in quiet times, and not my nearest centre so I changed it for a telephone call as I have severe anxiety (stress induced IBS, ADHD and Autism) and said I wouldn't be safe to drive at that time and location as it would create stress. Then that 9am telephone assessment was cancelled by the company 5 minutes after it was scheduled to start, and rebooked for today so I had another 2 weeks wait.
Twice during the call which started at 1:30 today the assessors line went dead but she called back after a long wait and DWP called saying she'd come back to me for a third session! Then they phoned and said her phone broke and someone else would call, then they called yet again and said the other assessor would call me in 10 minutes, and again 40 minutes later ( now 16:45) to say the system had gone down and they had to reschedule!! So over 3 hours on and off the phone.
They tried to reschedule for nearly 3 weeks ahead and I refused, they then found an appointment tomorrow at 11am which will apparently be on a recorded line, which I said was great because I believe they should all be recorded and I am recording at my end and had informed the assessors of this, as requested when my appointment had been rescheduled.
I strongly suspect the 2 assessors today (one I spoke with and the other who never actually called to finish the appointment as promised) were not happy with being recorded, the first went away to ask someone about me recording when I told her, so I assume she hadn't had anyone record her previously and was hoping she could refuse perhaps.
If they mess me about again I won't be able to cope with what will be a fourth wait to speak to an assessor, it's been such a stressful situation and I've sent loads of medical reports (online application) , and typed the maximum I could into all the boxes so they have plenty of information. What happens if I say enough's enough do your report from what you already have and refuse another wait for yet another appointment should tomorrow's go wrong?
I also have paid for 3 MRI scan reports for my back done last week, and awaiting a doctors summary to send which completely contradicts an NHS assessment, and refusing my GPs suggestion for MRI to investigate, as the doctor barely examined me and reported I just needed physio, and no nerve pain issues, despite my long history of pain after a car crash 30 years ago and now having recurrence of pain through my neck and back and numbness and pins and needles in arms and legs. My MRIs found a number of problems from degenerative disc disease, loss of cervical lordosis, fusion, bulging lumbar disc, slight slipped disc where neck joins thoracic spine, loss of height, Mordic endplate changes in several vertebra, anterolisthesis the list goes on and on but explains my pain is nerve irritation plus multilevel spondylotic changes at all levels.
Sorry, question on MRI is can I ask/expect them to await receipt of these before concluding their report, as on the phone she kept saying diagnosis aren't relevant, but I know I need diagnostic reports as evidence to back up all my claims, especially as they have the MSK doctor's report dismissing my issues and specifically stating it wasn't nerve irritation related which is proven wrong.
Many thanks, I hope I could have a reply before my appointment tomorrow please. i'm totally exhausted by it all as I was before!

Hi MuttonJeff
As your assessment was cancelled due to no fault of your own, then it should not be counted as a missed appointment.
What happens if I say enough's enough do your report from what you already have and refuse another wait for yet another appointment should tomorrow's go wrong If this was the scenario then you run the risk of your claim ending. I would advise you not to go down this route even, if you get very frustrated and I fully appreciate that at times it can be very frustrating not only for you but also for the assessor if they are having IT problems and I know from experience, IT can at times be very frustrating especially if you work from home.
In regards to the report you are waiting for, I would note it with the assessor and inform them that you will be sending a copy as soon as you receive it, you usually have 8 weeks from an assessment to a decision although you may be unlucky and a decision may be made sooner. Send a copy of the report to the DWP and mark it for the attention of the decision maker, if a decision is made before you send in your report then use it for your MR if you go down that route.
As for recording the assessment, you can legally record a telephone call without informing the other party providing the recording is being made for your personal use. Record the assessment surreptitiously. (Never trust that there won't be a problem with their equipment!), do not tell the assessor that they are being recorded as they will likely terminate the assessment.
Hope everything goes well for you tomorrow, let us know how you get on.
