I have received my Review Award. Very disappointed that I only received Standard rate for daily living. I rang customer services to gain more information, and the adviser said that for this review the DM had used an old medical assessor's report (PA3). Can they do this? It is so frustrating because the old assessor's report from 2019 was very poor in that it missed one of my consultant's letters. This time round, I sent very clear evidence with up-to-date consultant letter, and made references/gave quotes from the consultant's letter.

Hi Perdita

It can be very frustrating when old data is used, you need to ask for a mandatory reconsideration, either by phone or in writing using a CRMR1 form www.gov.uk/government/publications/chall...ork-and-pensions-dwp

If you phone up to request a MR have your supporting evidence to hand and explain what documents have not been taken into account, they may ask you to send them in, but if you have already sent them in then say so.

Explain what the documents are and who they are from.

IMHO this is discrimination by choice on DWP's part, not to say incompetence, inadequate customer service etc. If you have the energy, please inform your MP. I live in hopes that if enough MPs get enough evidence of this sort of thing, eventually they may do something positive about it!?!?
Do keep us posted anyway.
Best, Denby

Gary, thank you. Do I have to use that form, can I do an MR as a letter?

Hi Perdita

You can use what you like as long as you make it clear you are requesting a mandatory reconsideration.

If it is outside the one moth time limit then you need to explain why it is late, I quite often use waiting for the assessors report.
