Hi, I would appreciate if you can help me, my mother is coming up eighty, she is on DLA [she was over 65 when PIP came out so still continues for life on DLA] she is on lower rate care & highest rate for mobility, now her care needs have increased & mobility the same, we are wondering if it’s worth trying to see if she should be on middle or higher rate care, is it a case of just ringing the DWP up and explain that her care needs have increased? How would they go about assessing her? would it be simple or would she have to fully apply for PIP and get re assessed on care & mobility, she is concerned about going through a new process again and possibly loosing what she already has in DLA for life, I would welcome any advice, thank you very much for the wonderful work that you do,

We can not advise you whether or not to contact DWP and inform them of a change of circumstances if your mothers condition has deteriorated. They would look at the whole claim again.

If your mother was born before 08/04/1948 then she would stay on DLA.

Depending on your mothers circumstances, at present as she is not in receipt of middle care or higher then she is not eligible to claim a SDP if she were to apply for Guarantee Pension Credit in which case could potentially loose out claiming an extra £69.40 pw. + free TV licence when she turns 75 as GPC is a qualifying benefit.

We would advise you to seek help from either your local Welfare Rights Organisation or even Age UK.
