Hi, new here and just after a little help. My son was in receipt of ESA (support group)due to mental health problems until spring 2022 when he stopped receiving it as he began renting a home with his girlfriend who was in employment, her salary meant he wasn't entitled. He has permanently split with girlfriend, has had a lot of distressing events happen and is now living with me. The only income he has is P.I.P, first payment few days ago as I didn't know P.I.P even existed until Oct 22. Will he be able to make a new claim for ESA? I ask as at this time he is unable to initiate a claim himself due to severe anxiety. I work 30 hours per week, no rent or mortgage now so is it worth trying to help initiate a claim , ie will my income be taken into account so he won't be eligible? Thanks for taking time to read with everything that's happened and happening now I thought it might be easier to ask on this forum.

If he lost entitlement to ESA due to household income then his only option is claim Universal Credit.
Your income and savings will not affect his claim.

If he is in the support group rather than the work related activity group he shouldn’t lose his ESA because of his partners income as far as I understand it

If in support rather than work related group I don’t think her income is meant to be counted?

Thats not quite correct, if he is in receipt of IR ESA then her income would be counted whether or not he is in receipt of support group. If he is in receipt of CB ESA then her income would not be counted whether or not in receipt of support group.
