I am hoping I can receive some valuable information regarding PIP and zero hour work. My Daughter is on standard rates of both components as she suffers with chronic Endometriosis and depression. However, despite her being ill a great deal of the time, she has managed to actually gain employment within a well known Gym organization. She has taken into account her illnesses and as such, she opted for a zero hour contract with the company. She has worked a few shifts for them (and she has shed a lot of tears after), but she really wants to succeed. In fact, a few days ago she taught her first spinning class. She was buzzing afterwards, but then subsequently spent the whole of the following day in bed ill with this awful Endometriosis. She wants to see this through and she wants to beat this horrible disease, but she is wary and we have seen first hand the devastating effect it has on a person when it grabs hold. We are worried sick she might be doing something wrong if she carries on claiming PIP. There genuinely are full days when we have to have the children staying with us as she is in bed all day and night with her illness, but the PIP people will probably only see someone who looks fit and healthy taking a spinning class or similar. Can you please give some advice on what to do? I am aware of the 50% rule regarding PIP, but it is actually proving to the DWP that she is indeed ill for 50% of her time. We know she is, but if they come at her, how on Earth would we prove as such?

Claimants are allowed to claim PIP and work. The DWP's issue will be whether she can work because her condition has 'improved' since she was awarded PIP. Only she knows what she wrote on her form, what she said if she had a telephone or face-to-face assessment and what criteria she was awarded PIP for. She needs to look at that and see if it still applies.

One of the easiest ways to 'prove' how her condition affects her on a daily basis is to keep a simple diary. We know from members here that some have found their diaries have been key to their success in winning an award or challenging the DWP when they have tried to remove an award.
