If there is a death and the person is in receipt of benefits, disability benefit included. They have £9,000 in the bank account, any monies received after the date of their death has been paid back to DWP. (They die intestate)not aware of any other debts owed, can the money then be distributed to those entitled to it. The reason for the question is more about the fact the person was in receipt of benefits and the money in the bank account is likely to be from benefit payments entitlement from some time ago. I’ve been informed I may be entitled to a small share of the money by a family member but I can’t find out if they have confirmation from DWP this money is ok to distribute, only that any money after the persons date of death will be or has been paid back. I am estranged from the family member distributing so relations are tricky to find out. I’m not keen on taking monies even a small amount, if in the future there could be any problem. Thank you

Most benefits are paid in arrears, the executor of the estate usually sorts out the estate, puts an advert in local paper and London Gazette. If they pay out and debts are turned up then they may become liable, you do need to seek legal advice; www.gov.uk/inherits-someone-dies-without-will
