Housing benefit moving address in same council area was created by Dave107
Hi Everyone,
I have just moved (landlord sold my flat) and I am in the same local council area. I am on ESA support group and Housing benefit.
I looked on the citizen advice page and they state that if you move within the same local council area you can just change your address on your current claim. So I emailed the council benefits department with my reference number and change details but they just replied with a link to an online change of circumstances page. When I went to it it said I could not claim housing benefit and would have to make a new claim for universal credit. I am now panicking and don't know where to start? Do I definitely have to go on UC? I have only heard bad things about it.

Hi David
If you move within the same local authority area then you can still claim HB, it is just a change of circumstances, if you live in a trial area then that may be different.
I have read that certain areas in Cornwall are starting to move legacy benefits over to UC.
Remember David you are not claiming Housing Benefit as you already receive it, you are informing of a change in address.

Thanks Gary I am in Arun council in Littlehampton West Sussex. I don't know of any trial here. I will try to contact the council again.

Hi Gary,
I filled in the change of circumstance form online on 9th March and yesterday 11th received a benefits decision notice dated 9th March stating my claim for housing benefit is cancelled. Reason: Moved within area- please re apply.
On the application page it says I am not eligible as I am a private tenant. So it looks like I am being forced onto UC. On the back of the letter it says I can asked for the decision to be looked at again and if it is still the same I can appeal. But that will all take time and I see that as it is I won't get a UC payment for at least 5 weeks from applying. Do you know if they are allowed to cancel for that reason? I am in a state as the UC page says I will have to attend a work meeting and I am still in the support group and have not been re assessed yet. Do you think I should apply for UC straight away or appeal?

I cannot answer your question if you should appealer not as that has to be your decision. What I would say, you need to seek help from your local Welfare Rights Organisation advicelocal.uk and or your MP. You need to be aware of time limits, to appeal the decision it must be done within one month of the decision date.
It makes no difference whether or not you are a private tenant or a social tenant, if you move within the same LA area then you do not need to apply for UC.
