I was looking for some advice. I’m currently receiving ESA and PIP. I have the severe disability added to my benefit as a premium.

My toddler has just been awarded DLA. The application was sent in Mid-December 2022 and I rang them up today and they informed me he has been awarded from NOV 2022. It is suspected that my son is on the Autistic spectrum which has caused a lot of developmental and speech delays.

I want to request a MR as I feel they haven’t taken into account how difficult his “night time needs” I would like some support to challenge their decision so any advice/support would be appreciated. I wake up multiple times a night to attend to his needs and it takes him a long time to settle.

Additionally I was thinking of applying for carers allowance. I get child tax credits at the standard rate for him but have been told to contact HMRC to let them know my child is in receipt of DLA. Can I apply for carers allowance (I meet all the criteria) but I’m worried what impact this might have on my circumstances and benefits.

I too have complex medical issues which impact on my abilities but despite all the struggles I do the best to look after my son even though it can be at the expense of my pre-existing conditions.

I’m looking for any advice on how to best proceed with a MR as they feel because a sleep specialist is not involved his night time needs are not high enough for him to get the high rate. Should I do a diary? Also how will applying for CA impact on my other benefits.

There is assistance for requesting an MR in our guides section, follow the Guides link at the top of this page.

Be aware, you will to show that your child has significant care needs overnight above and beyond what would be reasonably be expected of a toddler of the same age.

Providing the DLA award is for Medium Rate Care (or higher), then you can a claim for Carers Allowance subject to you meeting the other criteria;

- spend at least 35 hours a week caring for your child
- do not earn more than £132 a week (after deductions)
- are not in full-time education
