Hi Sorry to trouble you again but my brother contacted me this morning to say his PIP payment has not gone in so it looks like they have based it on my calculation of points having received the report. I am part way through the letters to the decision maker.I don't know what to do first now.Do I spend a few more hours doing this and send it or do I wait and do MR bearing in mind that the decision letter isn’t here yet(although it should be soon as it is over 3 weeks since assessment and payment stopped today) Can I phone them before decision comes? Please can you give me direction? My brother relies on the money and it was so traumatic waiting almost 2 yrs for tribunal last time Thank you again Kind regards S

You can phone them before the decision comes. Phone them and query the fact that he hasn't received any money. Ask for a call back from a case manager to explain why they think he has improved. The only difficulty you may have here is if you don't have permission to speak on his behalf. Can you be at his home - when you make the call? I know you have your own health difficulties - so that might be challenging. Also - I would get the paperwork sorted so someone can be his appointee, and then it will make it much easier to deal with the DWP.

The decision letter may take as much as three or four weeks to get to you, but as there has been no money - it seems you were right, in which case - I would wait for the decision letter and focus on that - but if you're able - still try and phone them.

I'm jumping ahead here - but if this goes as far and you have to go to Tribunal - ask for a paper-based decision. These are being done far more quickly. One member recently only had a wait of five months. It's a long time without money, but much better than the 24 months your family had to endure before. Not saying that it's guaranteed to be as quick but paper-based decisions are always shorter.

Dear BIS
Once again thank you for your kind help.My brother phoned again really upset .I spent multiple hours going through his report yesterday but have tons left to do as I will glean some important info that we wrote up and sent that helped win his (paper based due to covid) tribunal last time.
I will phone when I can get to his home as its 30 mile round trip.Plus follow the advice to be allowed to speak on his behalf .
I’m still unsure as to plod ahead to send my assessment report to Decision Maker ?
Made myself even more ill yesterday trying to sort it but my brother is totally incapable of anything but simple things and relies on me to help.
Do his benefits get reinstated as soon as you phone to put MR in please?He can’t pay his bills

If you are right and the decision has already been made to cut his PIP, it won't be reinstated unless you can override that decision.

That's why I would ring if you can and query why his money has not been paid. It could, of course, just be an administrative error, or it could be that a decision has been made to change his award. If they confirm that the reason is that they have cut the award, that's when you want to ask to speak to a case manager.

They are unlikely to let you speak to a case manager immediately, but you could try saying you have travelled to be with your brother, especially to deal with this matter. They may offer to arrange a callback. Here lies the problem because you don't live with your brother, and I assume if they have a number on record, it will be his and not yours. You will have to do your best to try and get them to phone you back on your number, and your brother will have to confirm to them that this is alright. (He only has to say the word yes, nothing else).

If you get to speak to a case manager (and they may just say to wait for the decision letter), you want to ask why they think he has got better, when you have submitted evidence that his condition has deteriorated.

If you can't get to speak to anyone, but they confirm the decision has been made, there is no point in writing because it will make no difference. Then you will have to wait to put in for an MR, but at least you will have already done a lot of the work for it. If they won't tell you - you could still write, but know that it may not make any difference

This is a lot on you, and I hope that you manage to get it sorted, but do get the appointee issue sorted so you can at least do this sort of stuff from the peace of your own home.
