ESA Disability Premiums was created by rjstone
I was claiming PIP at the highest rates for both care and mobility. Also old style ESA contribution based plus some income based including Severe and Enhanced Disability premiums.
I received an inheritance, informed the DWP and they stopped the Income based ESA and the disability premiums but continued with the contribution based ESA at £129.50 a week.
When my savings are below £16000 would there be any additional support available again?
As my ESA claim continued would i be able to re-claim the income based ESA again with the disability premiums?
Or what would my best option be??
I really would need the benefits that come with IR ESA like free prescriptions, reduced council tax etc?
Thank you

Legacy ESA, which you appear to be claiming is a single benefit with two payment options; one based on your NI Contributions (CB) and the other on your personal circumstances (IR).

This means that although you lost the IR component some time ago it can be re-added to your claim.

You need to contact the DWP, they will send you an ESA3 form to complete which captures information about your current household financial situation, on return the ESA(IR) should come back into payment.

If your savings and assets exceed £6000 then there will be a £1/week deduction for every £250 in excess.

I would advise you keep records of how and when you spend the legacy inheritance so as not to fall foul of deliberate deprivation of income rules. DWP might want to know where the monies have gone. I'm sure one of admins can advise you better but DWP do have certain rules for things like personal injury claims etc so I assume it is similar if you inherit a sum of cash above 6,000
