Can l continue to claim free prescriptions while waiting a decision was created by louner
My question is whether I can continue to claim free prescriptions, while I am waiting for a decision.
I get the Income and Contribution based ESA.
I received two letters from ESA both written on same day in January 2023.
One of the letters said Income based part has been removed temporarily until we can determine if you are entitled. The other one said you are not getting anymore income related till your savings decrease.
Reason being l sold my house but got mixed up with the paperwork they needed twice so they didn’t know l purchased another property with sale money. They have the paperwork they needed now.
I have continued to claim free prescriptions but not sure what l should be doing.

Hi louner
I am sorry to hear of your difficulties and hope they will be resolved soon. I suggest you seek 1 to 1 advice from a welfare rights officer about this as they can look at all the paperwork etc and act on your behalf if needed. You can also ask the adviser about the prescription issue but if I've understood it correctly you are not currently actually receiving ESA Income related, pending a further decision on this by the DWP. I'm sorry to say that it seems to follow from this that you would NOT therefore currently be able to claim free prescriptions on the grounds of receivingi
it! I would therefore strongly recommend that you don't claim any further free prescriptions on that ground until you - hopefully - become eligible for it again. In the meantime I think you'll have to pay for any future prescriptions but you can ask the pharmacy for an NHS receipt ( this is different from an ordinary till receipt) as you may be able to reclaim the cost though I think there are time limits for this. Hope this helps.

If you are on means tested benefits such as income based ESA, but not contribution based, you are eligible for free prescriptions, and I think all you need to do is show your benefit award letter at the pharmacy to allow you to claim this. However there is also a scheme for people who are on low income. Additionally certain conditions and/or age will only permit free prescriptions. For more information check here.

I hope you won't mind me mentioning that the specific issue that louner is raising about free prescriptions is whether they can continue to claim free prescriptions on the grounds of receiving ESA Inconm Related when their claim for it is currently suspended! It seems to me - as rellected in my own post - that they would not be able to do so. I realise of course that there may well be other grounds eg age on which they may be able to claim free prescriptions and/or other free or reduced health costs.

In your post your say

If you have household savings and assets that exceed the ESA(IR) limits (£16,000) then you have lost your entitlement to ESA(IR) and as a consequence have no right to the associated benefits, such as free prescriptions, etc.
