Help needed .PIP assessor asked about my carer abilities not my PIP, very upset was created by Kerry
Hi Ive just had my PIP assessment and all the PIP assessor wanted was to question me about my terminally ill son and my ability to Care for him . He never asked me any questions about my disability and only asked “ how do you care for your son “? And “ what do you do for your son”.
He was so rude and my son is over 16 and I cannot talk about my sons disabilities because of the data protection act and I do not have my sons permission .
Caring is not defined in law and I said “ I do whatever he needs at the time” . He said “be more detailed” .I said this is about my PIP not my sons ,as he’s already been assessed , as we both are terminally ill.
He hung up on me. The entire phone call was less than 10 minutes
So now I may lose my disability because I won’t break the law and answer questions about my sons disabilities ….after he’s already been assessed .
I need a lawyer to help me with this , it’s not fair ,when I have already have a carers assessment and many disabled people care for other disabled people .
Please help .

Whilst it might be considered sneaky, by asking about what you do for your son the assessor will get a picture of what you are able to do for yourself, for example; if you prepare and cook a meal for your son then you can do one for yourself.
I'm afraid I don't believe there was any issue of privacy with regard to your son's conditions. The assessor did not need to know this information and was not asking about his problems, only about what you do for him, not why you do it.
Given the length of the call and how it was terminated, I think the assessor has taken the view that you were not participating in the assessment and will likely return your file to the DWP. The DWP should contact you for your reasons before deciding whether to end your claim.
