PIP Review - Missed Deadline - What typically happens?

My son was awarded PIP for daily living till October 2023.

He lives independently and even though I regularly prompt him, including about that we can expect a PIP form at some point, somehow, one was posted to him on the 11th February with a return date of the 11th March and he was also sent a reminder letter on the 2nd March yet he has failed to tell me anything about it till last Friday 7th April!

It’s very frustrating but is part of why he is receiving PIP and the challenges he faces with everyday things. I have called them today to ask for an extension and the man was very nice on the phone but said it didn’t matter.

He said the case has been sent off now but it’s taking 8-12 weeks to process so if I send it in quickly they would likely still be able to take it into account.

I’m going to get this sent off asap and I suppose I’m just looking for feedback about what he said? He said that his claim would not be stopped in the meantime.

Is all this correct? Should I be worried? I’m planning on putting a covering letter in about why the form was delayed and what was said over the phone. Is that a good idea?

Will they now ignore what I send in or are there cases where they have accepted it.

Would I get the chance to appeal a decision if they ignore what I send in.

There are two factors that will influence any DWP Decision that is pending.

First, the missing form is returned promptly, hopefully, so it is on file before any Decision is actually made.

Secondly, whether your son's file is marked as vulnerable, this should result in far more flexibility being used in what Decision is made. You should be able to check this by contacting the DWP but you will need to do this with your son in attendance as you have no authority to speak on his behalf.

I do have to warn you that there is a danger that his claim could be terminated but he will have a right of appeal if this happens.

When I called yesterday the man said on the phone something along the lines of his record being marked as additional support required. I’m not an appointee but I am on his account and they were able to talk to me about this (they wouldn’t he said if it was about financial matters) and I was called into a 3 way telephone call for his original claim to help him with his telephone assessment so fingers crossed this is a similar thing.

Am doing the form today and will send it in asap. It’s all part of the process I suppose. I will report back the outcome.
