Can IVA Company Take Backdated PIP Award Money?

I’m in the 4th year of an IVA. I’ve just been told by DWP that my award has increased (formerly on standard mobility only). Not sure what it’s increased to, but it’s backdated for around 2 years. They have said they owe me a substantial amount.

I’m terrified that the IVA company will take it from me. I’ve googled, and it’s unclear to me. It sounds like sometimes they can and do, and sometimes not.

Any advice and knowledge greatly appreciated. I can’t be happy about this until I know.

The question I would ask is how will the IVA company know you have been paid backdated PIP, you may want to ask DWP if they can pay you the backdate in stages.

They are paying in stages, but all extra income must be declared. The question is whether disability money is treated differently to other income?

Hi LA68

If the backdate is being paid in stages such as monthy then the amount received may be swallowed up in cost of living payments, just take into account the cost of gas and electric four years ago and now and then factor in all other house hold bills.

It would depend on the terms and condition of the IVA, in a DRO it would be classed as income, you need to speak to an Advice agency such as Citizen Advice or Community Law centre; advicelocal.uk
