Hi there
Just have a question regarding my mother's situation. She on on contribution ESA as she has some savings so this was the right one for her as it wasn't means tested. However, the 365 day is now ending as she is still waiting for an assessment to decide whether she's put in the support group. There is still a big waiting list of people waiting for assessments (I"m sure she will be put in the support group as she very unwell)
Once her contribution stops soon I know she can make a claim for UC but this is means tested and she wouldn't be eligible, whereas she would've continued to receive contribution if placed in the support group. It seems unfair that she could've carried on receiving contribution when she gets put in the support group, but due to the backlog of assessments her contributions will run out. I'm just wondering when they do finally assess her and she's put in the support group I presume payments and decisions get backdated therefore will she been classed as still on contribution based considering the backdated payment and decision will be from before her contributions ran out?

If your mother is placed in the Support Group then her ESA payments will be re-instated at the SG rate, there will be a back payment of the SG rate less any benefit already paid from the beginning of week 14 of her claim and she will also be treated as not having used any of the 365 days meaning if she is at some time moved back to the WRAG she will have another year of payments.
Have you contacted her MP? The DWP are supposed to be making efforts to avoid this situation and to make a Decision before the year ends.
