how long do i have to appeal or is it too late

Can you please confirm how long I have to appeal (or if I can't appeal if it's too late) a PIP decision? I got the decision in Oct last year. I did a Mandatory Reconsideration and got the same result in January. Is it too late to appeal? thanks

Hi mumsgirl

You can do an out of time appeal, providing you have a good cause. I frequently do out of time appeals, I picked up a case yesterday which is 11 months out of time, I have asked the claimant to get a copy of the assessors report before we can actually do the appeal.

We used the excuse of mental health issues, waiting to get a copy of the assessors report and waiting to get an appointment with an adviser, so far not had one turned down.

The maximum time is 13 months after which your claim will be struck out and you will need to re-apply.

I have been waiting 6 months for my assessment report from Social Care OT dept. They came out to my house during the pandemic and gave me aids that I needed and I wanted to use this report in the appeal but they keep ‘losing’ my request (they’ve lost it twice already!!) so I complained and send the 3rd request to the complaints manager and got a reply back saying they’ve received my request (like they did the last 2 times!) but it would take more than the usual 28 days. It now honestly wouldn’t surprise me if 13 months passed lol.
