I'm on long-term sick and receive contribution based ESA but still employed. The Income Protection is was provided free of charge
years ago by the company so the benefit and the calculation was done by the insurance company which pays out a fixed percentage of my wages pre sickness less any ESA that I receive. It is paid to me via my wages so pay tax and NI too.
As the insurance company quote is their policy booklet that they pay a % of pre-disability wages LESS any ESA that someone receives, then surely they have it right that I can claim contribution based ESA on top of the income protection payment that I receive from them but I'm concerned as I've read a couple of posts on the internet that this is not allowed.
The Insurance company must have it right I'm thinking but now I'm really confused as I've come across this
www.legislation.gov.uk/uksi/2013/379/regulation/64 Is anyone in the same situation as me or have any knowledge as to what the above link means.
Thanks
