As predicted, but not hoped, my 36 page mandatory reconsiderstion that ripped apart a shoddy assesment report and wenr into extreme detailnof my condition, was denied, and they have awarded the exact same thing as before.

It however has taken. 18 days for their letter dates the 2nd, to reach me (18th today) and i simply am not well enough to be able to get a complete response in to tribunal appeal within 10 days.
Im convinced they delay letters like this on purpose, as letters without an important deadline in front of them, from the same department seem to arrive 2 days after they have sent them. A seperate, suspicious issue that is not relevant.

I have contacted My local citizens advice 4 times via email in the past month and i have not yet received a response. The phone i have been constantly ringing never gets picked up and I can only presume they are overly busy (notnopen weekends).

To top this off, as my PIP review was started in England over 18 months ago, I have to appeal to English PIP, despite now living in Scotland, not Adult Disability Payment, so im unsure if citizens advice up here could actually help.

I know my next step has to be appeal to tribunal.
Even using the govenment appeal website to start this is confusing.
Knowing i am dealing with the english PIP from when living in england, if i put in my scottish postcode, will i be sent to the wrong scottish tribunal?!

On top of this can anyone tell me where i could find someone to help with this urgently?

Other factors huting me gettibg this to tribunal.

1) My medical records still have not followed me up here so are inaccessible, both to my GP, physios, council up here and to myself for help wirh tribunal.

2) I sent an infomation request to DWP almost 2 months ago now for all information they hold on file, previous AR1 forms and decisions etc and despite aknowledging they recieved this with a text on the 30th march which stated they would respond within 1 month, i have not yet gotten any information at all.


I wrote 36 pages to PIP in response to my shoddy assessment. It took 3 months.
There are so many issues and so much that was overlooked that i have no clue how to shrink this down for tribunal without missing key information.
I really need help to do this.

You have to lodge your appeal within one month, up to 13 months if you can provide Good Cause for the delay and this is accepted by the Tribunal Service.

You do not have to provide your detailed submission until one month after the date on the letter accompanying the DWP's submission, which you will receive when your appeal is accepted.

In reality, you can continue to submit testimony and evidence up to about two weeks before the hearing.

If you are in Scotland then your appeal will be heard in a Scottish Court but this will be no different from an English one.

(1) I'm afraid all you can do is wait.

(2) Chase the DWP for an update. I believe they have 40 days to respond from the date they received your request, I assume you made a Subject Access Request.
