Does being out of the country in the last 2 years have an effect on PIP Tribunal was created by Pepper
Hi Everyone,
I have been told that if I’ve been out of the country at any time in the last 2 years it would affect my PIP Tribunal, I’m basically appealing against the mobility component. Is this true? And if so, in what way would it effect me?
Thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

There are two aspects to this that could apply.
First, there is a Habitual Residence test for PIP but you would need to have been out of the country for a considerable period of time.
Secondly, if you leave the country, for example on holiday, there will be a number of obstacles that you will need to overcome, for example moving around in an airport or sitting on a plane for a long time. A Tribunal panel might be interested in how you dealt with this.
However, it does beg the question of how would a Tribunal know about this in the first place.

Thanks Gordon,
Makes me feel a bit better. However I have to be honest and say the staff at the airport special assistant team could not have been any more supportive in getting me from check in and on to the plane. I just don’t want to go into the why and where of it all, the airport part was the only easy part!
