Oi am in receipt of old style ESA income rlrated. I used to get a carer premium of £35 because of an underlying entitlement to carers allowance and my partner who os over state pension age got the same i.e. we got 70 in total. They have removed partners premium as DWP say he is not entitled to it over state pension age. I asked an advice agency today who said he should claim carers allowance online to get it reinstated. Is this right? I get ESA IR and he gets state pension of 181 per week

DWP are correct, state pension and Carers Allowance are known as over lapping benefits and you can only get the benefit that pays out the highest amount: CA £76.75, SP £203.85, as SP is the highest amount, the recipient will receive SP, they will however have an underlying entitlement which can be beneficial if they claim Pension Credit sometime in the future.

This is actually a lot more complicated than it appears, I believe the Carers Premium is still payable but there is also the possibility of a Severe Disability Premium becoming payable as well, however, this is all offset by the State Pension becoming going into payment.
You really need to get face-to-face advice from a Welfare Rights Officer who can properly calculate what you are entitled to. See
