Pip mandatory appeal was created by luthersgirl
Hi everyone I don’t know what to do my pip review was last March and have just received award and it’s been lowered to standard rate. Considering for the last 8 yrs have got higher rate and my pain from DDD , fibro and CFS has all got worse. I also wrote last year that I had a ruptured brain Annurisum and feb this year a major brain surgery to clip a bigger Annurisum . They don’t seem interested in this at all because the surgeon discharge letter said was fine. They stated that because my depression meds had not been increased and I’ve not seen anyone for my back pain recently was why it was lowered … for the last 2 years my brain probs have superseded anything else. Even though I survived brain Annurisum and brain surgery it has greatly debilitated me in lots of ways. I feel more depressed since receiving lower award . How can I explain this in a mandatory appeal
Please someone help they

Hi luthersgirl

Awards are generally lowered because the DWP believe there has been an improvement in a claimant's health. They shouldn't be lowered because a claimant hasn't seen a specialist for a few years!

If you're going to put in for a Mandatory Reconsideration, you need to get hold of your assessment report - PA4 (if it was a telephone or video assessment),or PA5 (if it was a paper-based assessment). The report will give you a clearer idea of why they came to specific decisions. You can ring the DWP for a copy (if you haven't already got it), and it will take 7 - 10 days to arrive.

You say that the aneurysm debilitated you (which it would have done) - but you need to make it clear post-surgery where you are still struggling in terms of the PIP criteria. I'm sure the surgeon said you were 'fine' meaning the surgery was successful, but it's up to you to show where it still has an impact and what symptoms you may have been left with, which are long-term or perhaps permanent.

You say that your pain levels have all got worse because of your other conditions. Did you describe in terms of the PIP criteria - what this means? What things have got much harder? Have you become less mobile, less safe, unable to repeat things...? Perhaps you explained all this, but if you didn't, you need to. Do have a look at our Guide- Best Ways to Challenging a PIP medical report.

The DWP often comment on the dosage of people's medication - and they quite often get it wrong. You may or may not already take the maximum dosage allowed - which is easy to check. But whether you are or not - it doesn't mean that your depression has improved! Only you can say what the continued impact it has on your life, sticking to the PIP criteria.

For further help in writing your MR - have a look at the Guide to PIP Appeals. You have one month from the date on your decision letter to put in for an MR. benefitsandwork.co.uk/guides-for-claimants/pip
